    You're referring to this?
    4. Browser Information

We collect data regarding the users of Last.fm, including: (i) The Internet Protocol (IP) address of the user’s computer. This may or may not be associated with a particular Internet Service Provider (ISP); (ii) The referring URL, if any; (iii) The browser software identification (i.e. the brand and version of your browser software).

That is just the information collected by the apache webserver logs, and every website you ever visit logs these things, even google. We have to state publicly that we record it legally though.

Ah, thanks for the answer, Jonty! Does that mean scrobbling and fingerprinting works without tracking user IPs? Until now, i've never been really sure about that.

I had to check up on this, both systems have changed a lot recently!

Scrobbling records IP addresses so we can detect spammers, fingerprint submissions are anonymous.

So there you have it folks - even if RIAA wanted the data (which they don't), and even if Last.fm/CBS agreed to give it up (which they won't), the only piece of information which could prove what was being listened to is already anonymized. Time for the tin-foil hats to go back in the cupboard, peeps.

(off-topic: the new U2 album is a Spotify exclusive rather than a Last.fm one? Another big coup for Spotify...)

Thanks again for the info, Jonty. Perhaps it should be explicitly stated in the policy text to avoid misinterpretations regarding scrobbling and fingerprinting which is a speciality of just this site. And thanks to StudleyUK for eloquently wording the conclusions for us.

Hey Last.fm! I've been with you for a very long time. I think while you were still in beta. Thanks for defending our privacy. Hope TC issues an appology.

If Id3-tags are valid evidence in court, so are my dreams...

How can anyone take this seriously...?

To people that know about computers, this is as obvious as anything. To people who don't work with MP3 files, they probably don't even know what those tags are or what they do.

Which is in my opinion a general problem with cases about some IT subject, and a large source of frustration.

Lol how would they know whether i've been listening to the full track or just a sample, anyway.

Yeah, you could even change your ID3 tags. Then is it still a criminal offence?
